Court gives EFCC, ICPC seven days to reply Fayose’s suit

An Ekiti State High Court sitting in Ado Ekiti on Tuesday ordered the Economic and Financial Crimes Commission and the Independent Corrupt Practices and Other Related Offences Commission to respond to a motion seeking to stop the probe into the finances of Governor Ayodele Fayose’s administration.


Other defendants in the suit include the Speaker of the House of Assembly, Department of State Services and five banks doing business with state government and the managers of those banks.

The motion was filed by the Attorney General and Commissioner for Justice, Owoseni Ajayi, to stop the anti-graft agencies from investigating the accounts of the state government.


He also sought an order stopping the arrest of the Commissioner for Finance, Accountant General and the managers of the affected banks.

At the last sitting, Justice Cornelius Akintayo while refusing the ex-parte motion had ordered the applicant to put the defendants in the case on notice to prepare for defence.

At the hearing on Tuesday, Justice Akintayo observed that the defendants were just served the motion on notice in court.

Before adjourning the matter till August 29 for further hearing, the judge said the date covered the seven days allowed in the Constitution for defendants to file their counter-affidavits.

The EFCC had frozen the governor’s accounts with Zenith Bank and some of his associates after allegedly tracing N4.7bn from the Office of the National Security Adviser under Col. Sambo Dasuki (retd.) to them and those of two sons of a former Minister of State for Defence, Musiliu Obanikoro.
